Ignatius Piazza: Stop Screaming, Start Shooting…

Here is the story.....
Deputy Kyle Dinkheller, Laurens County, GA, was minutes from being off duty when he encountered a speeding pickup truck going 98 mph. The deputy was an ICE (Interstate Criminal Enforcement) officer that dealt with traffic infractions, speeding and the occasional drug bust. This was a low risk or unknown risk stop for speeding. He radioed in the speeding infraction, made a U-turn in the median and pursued the vehicle. The driver, Andrew Brannan, stopped his vehicle, exited and started a crazy, dancing jig in the middle of the road while swearing at the officer and shouting ‘I’m a god-damned Vietnam vet.” At first, he ignored Dinkheller’s commands to step towards the deputy, which always began with `Sir’.

When he finally complied, he attacked the deputy and a scuffle ensued. The deputy implemented the use of his asp and ordered Brannan to `get back’. This procedure was repeated, but after what appeared to be a second scuffle, the suspect returned to his vehicle and retrieved a M-I Carbine from under the seat. The first shots were fired nearly 50 seconds after Brannan returned to his vehicle despite the deputy’s commands. Brannan ignored the repeated commands to put the gun down and Deputy Dinkheller apparently fired the first shot.

Brannan, a Vietnam veteran, advanced firing on the deputy. Dinkheller returned fire, but succeeded only in breaking a window in the driver’s side of the pickup and wounding Brannan in the stomach. Using `suppressive fire’, Brannan systematically, methodically shot Dinkheller in the arms, legs, exposed areas that would not be covered had Dinkheller been wearing a bulletproof vest, slowly executing him. Reloading his weapon Brannan continued firing with the final death shot to Dinkheller’s right eye.


Brannan was convicted and sentenced to death, here is that part of the story:

Brannan's Appeals Process

Brannan was scheduled for execution in May of 2003, but he was granted a stay of execution as he began his way through the appeals process. In criminal convictions, a direct appeal is immediately filed with the State Supreme Court, and ultimately the U.S. Supreme Court. In Brannan's case, the State Supreme Court upheld his conviction and death sentence; likewise the U.S. Supreme Court in essence affirmed the conviction by refusing to review the case.

Brannan's next standard appeal was to file the writ of habeas corpus, which sent the case back to the Georgia Supreme Court justices.

In petitioning for a habeas corpus, a defendant must prove that the court that ordered his imprisonment made a legal or factual error. Brannan's writ stated that he had been diagnosed by Veteran's Administration hospitals in Decatur and Augusta as suffering from Post Traumatic Stress Disorder and bipolar disorder. It further questioned whether Brannan was properly medicated at the time he killed Dinkheller.

In March, Superior Court Judge Richard C. Sutton of Butts County granted Brannan's petition, saying "this Court finds ineffective assistance of counsel" by Brannan's defense attorney during the trial in January 2000. Brannan was represented during his trial by Richard Taylor and Larry Duttweiler.

In his ruling, Sutton refers to "factual history" stating that Taylor was designated as lead counsel but had never represented a client in a death penalty proceeding.

Sutton stated in his ruling that Brannan's defense attorneys "completely undermined" his defense by not adequately exploring the documented history of Brannan's mental illness. The judge stated that Brannan's attorneys limited his defense strategy to "guilty but mentally ill" which Sutton said left Brannan's bizarre actions on the video unexplained.

damn, that was a lil intense... does this department not have pepper spray of tazers? are they not instructed to shoot to kill in a situation like this as soon as a weapon was presented? this could have been avoided or even had a totally different out take.

this should also be in the free for all section.
 
horrible stuff.....lots of "should've", "could've" stuff here.....f'ed up justice can't even convict the killer without tons of beaurocrat sh!t. i know the off. was scared to death, but damn it seems something would say hey, its me or u and it ain't gonna be me!
 
And this is what I find wrong with our judicial system, if an indiviual was sentenced to death... do it. Mr Manson has been on death row how long? how much have the taxpayers of California been paying for his sentence? You think having a mental illness would be a resonable reason to carry out the punishment, because of the means that which that officer died. Being that it could have been someone else, or worse yet... many others.

Ive always stated... lets not let the rights of the victums die with them.
 


If i was that Officer, i would have Shot first and let god sort it out.

That SOB needs to have all his limbs amputated and placed into a padded room with the lights turned off until he dies of dehydration. As the dehydration sets in, he would get the nice hallucinations driving him far more psychotic than he is. That would be a fair punishment while he's still living. Screw cruel and unusual punishment on cases like these.

As for the officer, I would have filled him full of lead as soon as he picked up the rifle and I told him once to drop the weapon. I would probably go to prison, but whatever. That video sickens me, but some people might realize what cops go through after watching this. He pulled him over for speeding and gets murdered. If you ever wonder why officers are sometimes hostile and pricks, this is good enough reason for them to be. They never know who they are stopping. Very sad video.

this... my friend at work saw the video and we got to talkin bout it. the vid makes me have alot more respect for police. sad part is... the guy had a wife and a kid and a kid on the way... googled some more info about the case. yea there were alotta shoulda coulda's. Taser!!! as soon as he got erratic and charging toward him or clip full of 40 cals in that dude as SOON as that rifle was presented.. gave the guy way too many chances to comply. also the report i read said the cop was minutes away from being off the clock.

I'm sorry, but if your unstable like that.. you should not be able to go out, who knows what can happen just like this poor officer gets killed? Why? Because this guy is "Unstable"? How did he get a gun anyways?? If you kill somebody you deserve to have no life either, plain and simple. Doesn't matter if you meant it or not.. YOU took this person's life, not somebody else, YOU. Getting away from this crime is dumb too because even if he was unstable and he gets away... fine... but now somebody is dead, their relatives lives are changed, maybe he had a family, kids... and why? Because this guy is unstable?? That's BS to me. Makes me angry and sick :th_angry2:

They used to teach "take downs" even with their guns but now its shoot to kill.

And I live in Canada...

The proper thing once the guy got in his face would have been to deliver some sort of blow to get him on the ground then hold him at gunpoint and call for backup or attempt to cuff him.

In texas, he could have been shot and killed the second he went back to his truck under something called "suicide." you run from a texas cop, he has the right to kill you.

better yet, remove his limbs and throw him in a pool. pulling him out of the water every minute for 5-10 seconds until he dies. that outta do it.
 


An officer taking a life is something they will have to live with the rest of their lives and is their last resort. Stun guns can't fire multiple rounds within seconds to act like a suppressing fire or make up for a missed shot or two. I think all officers should be required to carry a non lethal rubber bullet PISTOL for cases like these so that it's on them all the time. The guy touches a gun or so much as puts his hands in his pockets acting cocky like he did, shoot first ask questions later. And guy will be alive to answer the questions. Also, solid legislation providing protection under law that if you act like this guy did within the first 30 seconds of being stopped, it is MANDATORY to get taken down with non lethal force. JMO
 
Man, that just really made my blood boil since I read the story first. As soon as he saw the gun at bare minimum, tased, or tackled. I would have started to fire.

Just really sad... RIP
 
the officer should have diffused the situation WAY before it got to gun fire. but things happen. hate to see an officer killed doing his job.
