Getting knocked off my motorcycle



Its sad to see this thread. My wife's cousin was in a serious motorcycle accident this weekend in Virginia. From what we can piece together, he lost control on a curve in the mountains and struck the rear of another car. He was life flighted to UVA hospital where he is in medically educed coma. 5 ribs are broken, both lungs are punctured, 3 vertebrae are broken, shoulder is shattered. He's got tubes down his throat and one on each side of his chest. They say he is going to make it, but he is lucky that his twin was riding in front of him and noticed he didn't come out of the curve.

While your lucky to be alive and without serious injur...you had time to hit the horn and rev why didn't u just bail off the bike?

One of my thoughts too. Several of my friends ride and are always talking about how they have to be alert and prepared to get out of dangerous situations. It seems like this could be a good learning experience for the next time.

i didnt get off the bike because i didnt actually think shed keep going... this all happen within about 2 to 5 seconds at mooost.. it was just a instinct to just redline the bike and hope she stops.. and at 16,500 rpm with a full exhaust theres no reason in hell she didnt hear me.

Oh i confronted here... ive never sworn and yelled so much at a woman before in my life. the cops showed up pretty much instantly.

Honestly, revving is more of a distraction. Everything I hear a bike revving I start looking around to see who is trying to show off or race down the road. Even when in close proximity that never indicates to me I am about to hit them and takes my attention to a nearby intersection or road to see who is about to do something ignorant.

1) sorry this happened to you and that you got hurt. No one deserves it.
2) do not get greedy with the lawsuit bull crap. Get what you need and keep it simple. She probably isn't worth chasing heavily.

You do realize insurance will be covering all of this for her. They have attorneys and only if their attorneys suck will you get enough to be over the cap of that policy. You will never get her home even if the amount was that high. They won't allow you to take someone's home.

I have been in 2 car accidents in my life bad enough to go to the hospital, physical therapy, etc. From going through those I can tell you a few things. Any attorney who is trying to get you to go for everything is doing it for self enrichment. They typically get 40%-50% of everything they get for you. Not just pain and suffering. They will make sure they are paid first. So, if she has no money, the attorney gets paid first out of the insurance $$$ and you get what is left. If she ever pays, you will get that. Good luck getting paid even if you get a judgment. Most states have a 2 year statute of limitations and there are exceptions. You have time. Use it. Get yourself 100% better and go back to full physical activity to make sure there is nothing you are missing. Go to a legit dr to get checked out. Not some guy who specializing in working with ambulance chaser attorneys. They know who is legit and who is a bloodsucker working with ambulance chasers and it can affect validity. If you are told to go to physical therapy, do it. It can really help. I used to think it was all crap, but it really did help me both times.

Do not settle right away or sign anything for the insurance company until you are ready to settle in full. Do not accept the insurance companies first offer. They throw out a lowball offer up front. Can you seek Diminished Value for your bike having been damaged? Each state is different. Do your research. Research what is reasonable pain and suffer for your type of injuries. There is some good info on the internet. Typically an attorney will get more, but you end up with less by the time they take their cut. There is a reasonable and fair amount to expect. You can deal with the insurance company yourself, reach a reasonable settlement for the harm, med bills, etc. You are entitled to compensation, no doubt. Just be reasonable about it.

Everyone always complains about high insurance rates. Going after people like its hitting the lottery for being in an accident is why insurance rates are so high. Regardless of settlement, the cost of attorneys for the insurance company goes into claim costs. Any large settlements that are over and above because of ambulance chasers also goes into that. Insurance companies are in business to make a profit. This isn't free or they would go out of business. Those costs are all lumped into their calculations when they look at each person as a risk of payout and the average payout. By going for ridiculous amounts of $$$ you are sending your own insurance rates up and everyone elses.

2. Recoup med bills.
3. Recup loss of wages if any.
4. Recoup legal fees for yourself.

When I was a little lad probably 2, my dad just finished restoring his motorcycle and was out riding it with my pregnant mom and a drunk old guy backed out throwing them both off the bike and the bike was under the car...... he took no action... Thats retarded, your a idiot you get treated like one and you will be forced to pay like one until you realize your not the only person in the world.

**** I have almost been run over in parking lots WALKING because people just put it in reverse and go, Iv punched the the car a few times because they are that ****ing clueless. Then you have the nerve to look at me?!?!?!?! ***** Ill knock you the **** out! I dont play very well with illiterate people, should all be executed.

Agree, to many people have licenses that shouldnt. They seriously need to amp up the driving tests and with anyone older say 60+ require a test every half year or so. Some people are just simply to stupid to be behind the wheel but they make the driving tests so easy a monkey could do it, and risk everyone elses lives .
 
My driving test was going down the road a mile, around a block in a sub division then back to the bmv. Then a maneuverability test, which surprisingly a lot of people i knew failed. I passed it 100% without any points off I thought it was very simple. I found the 400 dollar or so drivers ed program through AAA I took, while most to me was common knowledge was actually really helpful. I guess common sense is kinda nonexistent anymore for some.

That really sucks. Glad you're okay (for the most part), but I agree with what Bio said - be an adult, and don't go crazy. As a runner, I can't tell you how many times I've almost been nailed by some a$$hat not paying attention on the road, at an intersection, or even their own driveway...I actually had to smack the back window of a Land Cruiser as I dodged around it to get it to stop...

Russdinoguy is absolutely right - there is no such thing as common sense anymore. People are so distracted when driving now, it's truly frightening. My son started running, and asked what to keep in mind when running on the streets, and I told him that he has to be hyper aware of what's happening around him because no one else will be, and to run with the mentality that every vehicle out there is trying to kill him. Seems that same mentality applies when on a motorcycle. Hope you heal quickly.

I honk at them...scares the sh!t out of them...
 


I get in front of them and brake check them, not in the gp but the truck. They end up all over the shoulder, classic. IL its illegal to even talk on ur phone if its not hands free, cant touch it.
