thanks that gives me a lot of ideas but I have another ? i got the oil changed the other day while they were working on it i seen it looked like someone beat the caty with a sledge hammer so i cut it off and added a pipe now my tranny fills like its slagging would no caty be the cause

The only thing I can think of is that since exhaust work was done, and I'm assuming you mean it's sluggish, the o2 sensors may be the problem. They could have been damaged or disconnected. Any codes?

no codes not sure what it is its like it wants to switch gear earlier than it should

First thought would be since you essentially deleted the CAT (if I am reading you right) the PCM is putting your car into limp mode. But it SHOULD be throwing a P0420 code...
