UnInsured Guy totalled my 98 GS

It took him 6 days to finally admit Not having insurance. I was crossing an Intersection and had to come to a stop slighty hard due to a guy turning out in front of me and then trying to turn left into a gas station, Girl in car behind me stops about half a car from me, guy behind her slams her pretty much at full speed hitting her so hard she hit my car twice.
My problem is I just put a bunch of money in my Regal and want to keep it. My insurance company says i should have the option to keep it.... Should is key word. Its only worth 4k fair value to them. To me its very sentimental.
What should i do?
 


Wayne Brady going to have to choke a b****? If it means that much to you, keep it and try repairing it?
 
Does your policy insure those that don't have insurance? If so let them total it and buy it back. My 99 GTP was 500 bucks to buy back. It needed a hood, fender, headlight/bracket.
Also. As long as they dont get the title it will remain non salvaged. Like mine.
 
Add up the cost of your aftermarket parts plus the labor a shop would charge to install and make your insurance pay for it all. They will get that and then some from the guy in court.

Then let them have it. A totaled car is ALMOST never the same.

Also, file a civil suit for pain and suffering, you should come out with a substantial check from that as well, since he is uninsured.
 


Not sure how it is in OH, but in OK you can take the police report and file papers with the D.O.T. and until he pays restitution he will lose his license. Had a similar incident with my mother and she got the money from they guy, but it took like 6 months. People tend to straighten up when served with papers stating they will lose their license indefinitely until its paid.

If he couldn't pay for insurance chances are the guy won't have jack to pay HIM with. Have the guy pay your deductible and sign all the nesc forms.

Not true. I know of lots of people that have had no insurance and been well off. Its usually a choice not to get it, but there are times it can lapse.

Yup, the girl that hit you is responsible for your problems, not the guy that hit her.

Depends on the state I guess... Since it was a chain reaction accident, the PD could have filed the accident with the rear car driver being at fault, meaning the damages were all on him. A guy I know hit a car, then after he hit it, he got hit, and it was the guy in the rear's fault for both vehicles.
 


Nothing that can't be changed in court. Frankly, the insurance company should be deciding fault on their own, anyway, using the police report as a supplement.
 
Not exactly, its mostly based on state law, I know in Nebraska, as well as most states (to my knowledge) any accident involving rear end collision is the fault of the rear vechicle. If more than one is involved, it is considered a domnio effect, unless all parties state it to be otherwise or enough evidence is forund to make the officer make another decision.

And whatever an officer says goes until a judge says otherwise.

Also police reports weigh heavily on an insurance company's decision.
 
I got rear ended a while back. I was stopped behind a truck and the car behind me was stopped and some guy came flying up and hit the car behind me and pushed me into the truck in front of me. It's the guy that started it all's fault they will go after him. The girl's insurance will have nothing to do with it.
 
That's not how it works. Guy I know got slammed from behind and pushed into another car. Even though he had nothing to do with the accident his insurance had to pay out on the car he was pushed into, but then his insurance went after the guy that caused the accident for both cars.
 


In the end he is, but when you are hit from behind the car that hit you has to pay for yours, regardless of if they were forced into you or not.
 
I've been in 2 accidents where i was pushed into another car and my insurance was never contacted at all.
 
Well I have had two shops look at the car as of now and both said it will be totalled. Second guy said for me to just have the adjuster come out and make sure to look around for other regals at dealers in the cincinnati area for fair market value and all.
I am going to make a doctors appt now that i know he has no insurance, not to screw him as much as possible but because im not rich and didnt wanna have to pay outta my pocket unless necessary. My hip ain't been right since. Thanks for the replies fellas!
