sorry bro.....I'm not a lawyer but I do know that any lawyer wont respond in print with advice. What they will tell you is get a lawyer.
Your best bet is to place some calls, then get back to the one who gives you the feeling of being your advocate. Good luck.
 
Well maybe i'll just ask people based on their previous exp. lol.

If one person wants the divorce and the other does not, and they have been living apart for over a year, have a child together but are currently in court for visitation, how can the person get the divorce pushed through?
 
Thats tough man having children involved, keep your cool. GOOGLE filing for divorce and get a lawyer. If I was doing that I would want a female lawyer, my reasoning being she would know the real angles from the other side. Sh1t the times I had child support hearings I had a man hating dyke as a commissioner and was doomed cuz I had a dick no matter who my lawyer was. Bottom line is there are so many variables involved you just have to hope for the best, keep your cool and roll with the outcome. It WILL get better......Be Cool
 
Well she wants it but he wouldnt sign the papers. He's most likely going to get thrown in prison within the year for at least 5 years for pending charges anyways. Is there any way to get it court ordered for him to sign it whenever he gets sent to prison?
 


cant she sue for abandonment if hes in jail? thats a free divorce.

and if they are legally separated, sounds like it, if shes going for custody, then even if married, he needs to pay child support in most states.

If the first part is true, then that'll be a lot easier lol. They havent been together for about a year, he was being stupid and tried getting her for child support/visitation when the baby didnt even live with him nor had he seen much of the baby since born. They are in court for visitation/child support but he is already ordered to pay child support, which he's only sent 3 times. He doesnt show up to the court dates for the visitation because she wants the divorce and he has pending charges(i guess afraid they'll take him in).

I just hope once he's convicted and sentenced that the divorce can be forced to be signed.

The lawyer she has for the custody/visitation is a real piece of work. doesnt seem to be in it for her, always rescheduling the court dates because he doesnt show.
 
sounds like a cluster fvck for sure, they will find him and lock him up sooner or later, once hes in jail, she will have more control i'd think.

A lot of what your asking will depend heavily on the state and county. Some counties require certain time periods for certain things, some have special rules... you need a lawyer that specializes in divorce with experience in the specific county.

Look at me, I can afford something much nicer than a W body. Refuse to drive anything nice to work and have it get beat
