There should have been a sticker or marker on the the bar stating which side was down. Not sure what happens if you mount it upside down but you might want to double check it. I've installed a few a these bars on different 97-03 cars and never had an issue.
What end links are you using to connect the bar to the a-arm?
I ask this because if the end links are too long, it could definitely position the bar to the point it could make contact with the tie rods.
FWIW, I thought the end links were a little long with my kit too (they came with the zzp sway bar that I bought), but when I put them beside my oe's they were the same length. Also, some folks (myself included) choose to flip the sway bar upside down to allow a little more room for a larger diameter dp. I sized mine up both ways, and the ends were not close to the tie rods either way.
Well what was the problem I'm curious now?
replaced sway bar on mine with kit from rock auto....now my cat is touching the new sway bar. Was work getting it in , theres just not a lot of room. middle of bar bends upward as oem one did. but new bar is heavier and may even be a bit bigger. ???

Mine is very close to the tie rods when the wheel is turned all the way.
