    Your DUI laws are almost identical to ours here. Sounds like you have terrible enforcement AND judgement. The law clearly states:

    A. It is unlawful for a person to drive or be in actual physical control of a vehicle in this state.....


    With the car on stands, you were sure not in physical control of the vehicle.

    I was told "with keys in pocket, you have legal control". In Az there is an "impaired to the slightest degree" clause and on top of that, if you refuse a bac test then you automatically lose your license for a year and have fines even if it turned out you were not drinking lol. Its called "implied consent".

    Anyways, the whole point was, thats how I became a GTP owner. Good times man, good times lol

    not knowing why the cops were called in the first place, but im willing to bet someone got lippy with the cops is my guess.

    If i read that right, it was a south park style domestic fighting kind of thing that got it started.

    then someone was acting out of line, the cops took him on a BS charge to shut him the f up is my guess.


    pure speculation on my part, but i see no reason for a cop to give a dwi just cause your keys were on you, unless he was searching you how else would he know?

    The whole DUI system down there seems to be FUBAR. It seems like a California type of law.

    I have seen it with a friend, as well on an episode of COPS once. On COPS a guy wrecked his car drunk out of his mind. Police did not witness the accident but they found the driver walking away from the scene. They said they could not charge him with DUI because they did not personally see him driving the vehicle while intoxicated, but they could charge him with leaving the scene of an accident.

    A friend of mine did the same thing. He put his truck in a ditch after having too many to drink (thankfully he didn't hurt anyone else or himself.) He walked away from the truck and called someone to come get him. Cops showed up at his house a few hours later and charged him with leaving the scene, even though they knew he was drunk when the wreck happened.

    As for implied consent that is in just about every state in the union and is part of the agreement you are bound by when you get your driver's license.

    Leaving the scene is one thing, but being charged with DUI when not driving.....BS!

    I too witnessed a drunk hit-n-run years ago. Called the police, they came and got my story, then drove to the drunks house and arrested him. Not sure of the charges, but when I showed up at court, I was told that I could go home; as soon as the drunk saw us witness', he turtled and plead guilty.

    I was threatened with arrest after we left a bar and I was hammered. We all stopped off at the late night eating establishment and they all got out went in to eat. I was way too drunk and just stayed in the truck with it running and was laying my head out of the passengers side of the truck, heater running full blast. Someone told me I could get a DWI and I told them I didn't care I wasn't going anywhere anyway. Well they called the cops and when they showed up they wanted me to take a sobriety test to which I told them I was too drunk to take and my friends saw what was happening and came out and spoke to one of the cops. She told them what I had told them and they said they could charge me and they just calmly explained that it was too cold and I was too drunk to take inside, the truck only had power windows and she didn't want me barfing inside her truck that's why they left it running. They even helped me back into the truck and put my seat belt on me and left. My friends went back in and finished eating and we went home. I didn't smart off and didn't talk back I was just really drunk.

    I was just telling my damn story about how I came to own a Stupid grand Prix! lol (not mad, I think its funny) I didnt expect MY EXPERIENCE to get picked apart and become the main topic lol.
    There is no need to try to tell me how it is here in AZ if you dont live here in AZ hahaha. It kinda makes sense that most states have many laws that are the same or real close, IE implied consent.

    It really happened. It sucked real bad. Now I have a GTP and my license back... End scene... Huge thumbs up.

    Years ago I was out drinking with some bud's. One was hammered, so I drove him home in his Bronco. Half way, he apologized and puked out the passenger window. When we got to his place, there was puke all down the passenger side of the truck. He apologized again. I laughed and reminded him that it was his truck. He wasn't impressed. LOL

    I went out to New Jersey to party with some friends one weekend. We all went out to a club to have some drinks and hang out. I drove with two friends riding along. The funny thing there is I had a 1st gen turbo Talon and one friend was 6'7" 400 lbs. The other was probably 5'7" 180 and rode in back. LOL

    Anyway we called it a night and headed out. Some of us got separated and we went the wrong way. When we got back to the house no one else was there, even though it took us way too long to get back. I kept calling phones until someone answered and when he did he just said, "Hans is getting arrested. I'll call you back."

    So, to end a too long story when they left my friend Emilie was drunk as hell. As Hans was pulling out Emilie decided to open the door while he was still moving to puke. Cops right behind him pulled him over. He had been drinking but he was never charged with DUI. He actually got charged because his car wasn't registered and he didn't have insurance. When the weekend rolled around his main car broke down so he put those plates on a car he had at the shop to sell. I think he also had a warrant for a previous unpaid fine or something and that was the main reason he got arrested.

    Anyone who gets fined for a dui while not in a car didnt fight hard enough. I took a assault case to jury and won. Dont fck with me if I am telling the truth. I dont bow down for no one.


    P.s I got a dui warning years ago, I slept in my bed and even drove my car home that night
